How to Start a Street Vendor Business with a Tricycle Cargo Bike

In a period of CRISIS, RECESSION and UNEMPLOYMENT like this, the smartest way to start an entrepreneurial activity without running big risks is the Micro Enterprise of Itinerant Sales, setting up your Shop on simple 3-wheel Work Bicycles. What to do to obtain the Type B Itinerant Trade Authorization

The "Itinerant Commerce" or "Commerce on Public Areas" is mostly governed by Regional Laws pursuant to titles I and X of Legislative Decree n. 114 of 31 March 1998, which brought about a radical change throughout the commercial sector.

When you go to a designated office to ask for the Itinerant Licence, explain that it is a MOBILE COUNTER and not a CAR SHOP.

This is because in the offices in charge, they often do not understand what a Cargo Bike is, they do not know that the road standard considers it to be equal to a Velocipede, therefore to all intents and purposes it is a simple Bicycle (it must not exceed 3 meters in length, 1.30 wide and 2.20 m high). By not specifying that it is a Banco Mobile, you run the risk of being assimilated to the Autoshop, which requires a license plate, insurance, etc.

If they should create problems for you and deny the traveling license, ask for a written response and on the basis of which Rule, Article, Paragraph they are denying you the premise.

The rules are different from municipality to municipality, or better... they are interpreted differently and often in a subjective way.

It even happened that a municipal employee tried to assimilate a Hot Dog Bicycle to a Forklift, which needed an Orange Flashing Light and an escort to carry out the manoeuvres.... of the Exceptional Transport type.

With a written response instead, an official must expose himself and must assume greater responsibility, and faced with having to provide a written response, it is probable that the interpretation of the law becomes more objective... Authorizations on AA.PP. THEY ARE OF TWO TYPES: 1) Type "A" provides for the use of a stand in a market area and is issued upon request in the Municipality where places are available, at the same time as the ten-year concession contract for the stand itself and allows for sale in itinerant form within the entire Region in which it is issued and participation in Fairs throughout the national territory. Of course, in Municipalities without parking, the only way to obtain an "A" type Authorization is by SUBENTRY into the same Authorization which can be obtained with a Notarial Deed of Transfer of a Company or Company Branch or through private deed always legalized by a Notary.

2) Type "B" is issued upon request by registered letter, by the Municipality of residence and allows: - Commerce on an itinerant basis throughout the national territory; - Trade in Fairs; - Trade in the markets, limited to unassigned or temporarily unoccupied stands due to the absence of the holders.

To acquire these Authorizations, you must meet the subjective requirements established by the legislation on the subject and by the objective requirements, depending on the type of trade you wish to carry out.

For the sale of "NON-FOOD" products, it is sufficient to submit the application to the Municipality, without having any professional requirements in this regard.

For the sale of "FOOD" products, it is necessary to have at least 1 (one) of the following professional requirements, demonstrable with various certifications:

FOR INDIVIDUAL COMPANIES: 1) to have been registered in the REC at the Chamber of Commerce of __________________ with the no._______________________ 2) to have successfully attended the professional course for trade in the food sector for a number of hours _____ (envisaged in each individual region), indicating: - the name of the Institute _____________________ site __________________, the object of the course __________________, the year or the end date; 3) to have independently exercised the sales activity in the sector, indicating: - the type of activity _____________, from __________ _________ to ____________________________________; - the N. of registration in the business register _______ C .CIAA of ______________n REA_______; 4) to have worked for companies carrying out sales activities: - company headquarters ___________________, company name ______________________________________ a) as a qualified employee, duly registered with INPS, from ____________ to_____________ b) as a family collaborator, duly registered to INPS, from _______________ to _______________ 5) be in possession of a hotel school diploma or diploma or equivalent qualification (the equivalence must be certified, upon request by the interested party, by the institution that issued the qualification)

ONLY FOR COMPANIES: - OF PEOPLE, IN THE COLLECTIVE NAME (snc) AND SIMPLE LIMITED PARTNERSHIP (sas) (other types of companies cannot operate in public areas)

A) Declaration relating to the following wording: - “that the professional requisites are possessed by Mr. (report all personal data and residence with indication of the position he holds within the Company). Once the administrative authorization has been obtained, the VAT number is opened and the Chamber of Commerce and INPS are registered.

 

Remember that a Tricycle is a Velocipede and does not require homologation, therefore in the following Rules, the Tricycle is a TEMPORARY MOBILE BENCH
